Public offer
This document is a public offer by Self-employed Шишкин Геннадий Николаевич (the Contractor) to enter into an agreement for access to botnest.
1. Acceptance and formation of the contract
The user accepts this offer by checking the acceptance box before payment and paying for the selected plan. The contract is formed when payment confirmation is received. The offer date and version recorded with the order apply to that paid access period.
2. Subject of the contract
The Service Provider grants time-limited access to an online service for creating, configuring, and operating Telegram bots. Available features and usage limits are determined by the selected plan. Telegram, Robokassa, and LLM providers are independent third-party services.
3. Pricing and plan changes
The price and access period are shown on the pricing page and in the payment form before payment. The Service Provider may change plans and prices by publishing updated information on the website. Changes apply only to future purchases and do not affect an issued invoice or an already paid access period.
4. Service delivery
Access is activated after server-side confirmation from Robokassa, usually immediately and no later than 15 minutes. Access is valid for 30 calendar days or another period explicitly stated in the selected plan. No physical delivery is provided.
5. User rights and obligations
The user must protect their account and keys, comply with the rules of Telegram and connected services, and not use botnest for spam, fraud, unlawful content, interference with third-party systems, or infringement of third-party rights. The user is responsible for the content and lawfulness of their bot settings and messages.
6. Service Provider rights and obligations
The Service Provider maintains the service, may perform maintenance, address security threats, and restrict clearly unlawful or harmful use. Where practicable, notice will be published before material planned limitations.
7. Third-party services and LLM keys
Unless a plan expressly states otherwise, fees charged by OpenAI, OpenRouter, and other LLM providers are not included. The user connects their own key and pays the provider directly. The Service Provider does not guarantee uninterrupted operation of third-party services.
8. Cancellation, refunds, and claims
The cancellation and refund terms form part of this offer and are published on the “Payment, Service Delivery, and Refunds”. Send requests using the Service Provider’s contact details. The parties will attempt to resolve disputes through a pre-court claims process without limiting any mandatory consumer rights.
When switching plans, unused paid days from the current access period are carried forward, and the new period is added to the remaining term.
9. Liability
Each party is liable to the extent provided by applicable law. The Service Provider is not liable for service unavailability caused by the user’s breach, blocking or failures of third-party services, internet outages, or equipment outside the Service Provider’s control.
10. New versions of the documents
The Service Provider may update this offer, the plans, and related rules by publishing a new version on the website without individual advance notice, unless the law requires otherwise. A new version is an offer for future purchases and applies after its publication date only to the extent permitted by law. The terms of an issued invoice and an already paid access period remain unchanged; a new version cannot waive or limit mandatory consumer rights.
Before each new payment, the user reviews the current version and accepts it using a separate checkbox. Continuing to use the free service after publication acknowledges the update but does not replace separate consent where the law requires it.
11. Term and termination
This offer remains valid until withdrawn or replaced by a new version. Paid access ends when the purchased period expires. There are no recurring charges or automatic renewals.
